Consequences of Multiple OVI Charges

Penalties for a Second OVI Offense

If a driver is charged with an OVI for the second time, they can expect consequences including:

  • 10 days in jail (minimum);
  • Fines ranging from $525 to $1,625;
  • Court-mandated treatment or education;
  • The driver’s vehicle immobilized for 90 days; and,
  • BMV enforced driver’s license suspension, reinstatement fees, and potential classes.

Penalties for a Third OVI Offense

For drivers who receive their third OVI charge, they will face repercussions including:

  • Jail time of 30 days up to one year;
  • Fines ranging from $850 to $2,750;
  • Additional court-mandated treatment or education;
  • Vehicle forfeiture; and,
  • BMV enforced driver’s license suspension for two to ten years in addition to reinstatement fees and potential classes.

Penalties for a Fourth OVI Offense

Drivers with a fourth OVI charge can expect penalties including:

  • Jail time of 60 days to up to one year;
  • Fines ranging from $1,350 to $10,500;
  • Additional court-mandated treatment or education;
  • Vehicle forfeiture; and,
  • BMV enforced driver’s license suspension for two to ten years in addition to reinstatement fees and potential classes.

If a driver is convicted of a fourth OVI offense within a six-year period, the offense will automatically be considered a felony meaning the penalties could be even more severe.

Penalties for a Fifth OVI Offense

If a driver faces charges for their fifth OVI offense, the consequences include:

  • Jail time of 120 days minimum to possibly 60 days in prison;
  • Higher fees; and,
  • Additional restrictions and fines from the BMV.

Drivers convicted of their fifth OVI in a 20-year period will also be added to Ohio’s OVI Habitual Offender’s Registry. This is a public internet record listing a driver’s name, date of birth, address, and convictions. Names are kept on the list until a driver no longer has five previous OVI convictions within the past 20 years.
